Senate Majority Leader John Thune has filed cloture on the CLARITY Act, formally the Digital Asset Market Clarity Act — but the first procedural vote won’t happen until Tuesday, September 15, pushing the bill’s fate deeper into an already compressed legislative calendar.

🧮 Why 60 Votes Is a Steep Climb

Invoking cloture requires 60 votes to end debate — meaning Republicans, who hold 53 Senate seats, need at least seven Democrats or independents on board just to bring the bill up for formal debate, let alone pass it. Two sticking points remain unresolved:

  • Stablecoin yield: Whether stablecoin issuers should be allowed to offer yield to holders, which banking groups worry would let stablecoins compete directly with savings accounts

📉 Market Odds Have Cooled

Galaxy Research has cut its odds of the CLARITY Act becoming law in 2026 from 50% down to 30%, citing the Senate’s shrinking calendar ahead of the November midterm elections. Crypto Council for Innovation CEO Ji Hun Kim called the cloture filing “a critical step forward” while acknowledging the industry had hoped for full Senate consideration before the recess.

Industry groups say they plan to spend the August recess working both sides of the aisle to secure the votes needed for passage.
